    Cardi B Set to Face Jury Trial for Putting Man's Tattoo on Album Cover

    The ‘Bodak Yellow’ hitmaker is being taken to court by a man for using a tattoo, that resembles a design he has, on the provocative cover of her mixtape.

    AceShowbiz – Cardi B will face a jury next year (21) in a trial over claims she used a man’s distinctive tattoo on the cover of her debut album.
    Kevin Brophy, Jr. has claimed the man orally pleasuring the rap star in the photo on the front of her “Gangsta B**ch Music Vol. 1” mixtape has skin art on his back of a tiger battling a snake that resembles a design he has, and is demanding $5 million (£4 million) in damages for the violation of his right of publicity.
    While Cardi hit back and asked for a dismissal of the case in August (20), U.S. District Court Judge Cormac Carney rejected her motion. The case went to federal court on Friday (04Dec20), with Cardi arguing the cover image is transformative fair use of Brophy’s likeness.
    However, Judge Carney disagreed, stating, “To constitute a transformative fair use, the revised image must have significant transformative or creative elements to make it something more than mere likeness or imitation. A reasonable jury in this case could conclude that there are insufficient transformative or creative elements on the GBMV1 cover to constitute a transformative use of Plaintiff’s tattoo.”

    “Most significantly, defining elements including the tiger and snake remain virtually unchanged. Under these circumstances, a jury will have to decide the merits of Defendants’ defense.”
    Judge Carney also nixed Brophy’s expert on how much damages he should receive after he had turned to proposed expert Douglas Bania to work out how much money was related to the use of the image for “Gangsta B**ch Music Vol. 1”.
    “Put another way, Bania’s theory means that if Defendants had not used Plaintiff’s tattoo on the GBMV1 cover, Cardi B would have made no money on the album – at least on the streaming services where the tattoo appears. There is absolutely no basis for this conclusion, and the Court in its role as gatekeeper will not allow a jury to rely on it,” Judge Carney said.
    Punitive damages are still on the table, however, with the trial headed in front of a jury next year.

    AceShowbiz – Teyana Taylor shocked fans when she hinted at retirement in an Instagram post on Friday, December 4. Apparently, not only fans but also fellow musicians were surprised by the post with Cardi B showing support for the multi-hyphenate artist.
    Taking to her Twitter account to sing Teyana praise on Saturday, the Grammy-winning raptress wrote to her followers, “If you know me then you know Teyana Taylor’s album it’s my favorite of 2020,” referring to Teyana’s “The Album”. “I swear she really got the best album this year.I hate that she feels how she feels cause she sooo talented and the music is soo good.”
    When asked about her favorite song of the album, Cardi responded, “Tuh where do I start ……Wake up love,1800,morning,69,killa,…..Lose each other’s had me in my feelings in the beginning of October.” The “Bodak Yellow” hitmaker further alluded that it was hard to pick a favorite since it was “just a very good project maaaannn.”

    Teyana was among those who were snubbed at the 2021 Grammy nominations. Despite her critically-acclaimed set “The Album”, which was released in June, the “Lose Each Other” hitmaker was left with no nomination for the upcoming award-giving event. In the eyebrow-raising post, Teyana shared a Spotify data about how her music is streamed in 92 countries by 15.2 million listeners.
    “Wow, who did that? Y’all did that! Thank you. I ain’t gone front in times of feeling super under appreciated as a artist, receiving little to no real push from the ‘machine’, constantly getting the shorter end of the stick, being overlooked, I mean the list on and on lol..,” she wrote in the caption, befire announcing, “I’m retiring this chapter of my story with the comfort that i can depart with peace of mind seeing that all the hard work & passion put in was indeed loved & supported somewhere in the world!”
    Concluding her message, Teyana, who is signed to Kanye West’s G.O.O.D. Music, added, “To all my supporters from day 1 & all my new ones I love you and I thank you for everything & don’t worry y’all know. all hustlers have the understanding that when one door closes another will open…either that or I’m pickin da locks petunia!!! So wassup.”
    Back in November, Teyana blasted Recording Academy. “Y’all was better off just saying best MALE R&B ALBUM cause all I see is d**k in this category (sic),” she tweeted.

    The “Bodak Yellow” star has a fair few collabs under her belts – including the chart-topping “WAP” with Megan Thee Stallion and tunes with Maroon 5, Bruno Mars, and 21 Savage – but told Billboard that when it comes to teaming up with her peers, she struggles with the initial stages of contact.
    “The thing is, I’m shy and really shy to reach out to male artists, to be honest with you,” she said. “That’s why a lot of collabs that I want, I haven’t gotten yet because I’m scared to reach out. I always get a little star-struck. I’ll be thinking I’m corny, even though I’m funny.”

    Cardi, who hit headlines with the raunchy lyrics of “WAP”, also said that her shyness can also be an issue when it comes to her laying down romantic songs.
    “When it comes to me writing or putting ideas of my personal life in the music I get really shy,” she said. “When I perform songs like Be Careful or Ring I usually close my eyes because I get really shy about showing that lovey-dovey side. Even to my engineer, I start giggling… like, ‘Oh my God, I can’t. This is so embarrassing.’ ”

    She, however, remained unapologetic over her racy lyrics. “I want to show people that you can do positive things, but you can also be yourself. I’m a very sexual person. I love sex, and I like to rap about it. I like to do it,” she explained.

    The 28-year-old rapper became the first artist in history to win Favorite Song in the Rap/Hip Hop category at the awards twice – first in 2018 for “Bodak Yellow” and on Sunday for “WAP” with Megan Thee Stallion.
    While stars such as Jennifer Lopez, Bebe Rexha and Dua Lipa attended the socially-distanced awards ceremony, Cardi missed out in favor of getting her teeth looked at.
    “Thank you guys soooo much .Me and Meg really appreciate all the love from fans ,celebs everybody that supported the song. Also thanks for voting,” she tweeted.

    Cardi B expressed disappointment for inability to attend 2020 AMAs.

    Cardi, who was also nominated for Favorite Female Artist (rap/hip-hop) at the event along with her collaborator Megan and her nemesis Nicki Minaj, lost out the title to the “Anaconda” hitmaker.

    AceShowbiz – Cardi B has reacted to backlash over her being titled as Woman of the Year by Billboard. The “WAP” hitmaker silenced her haters for questioning her credibility for being honored with coveted award.
    In a video which she posted on Instagram on Wednesday, November 18, the wife of Offset said, “For you cry babies like, ‘What? She only got one song.’ Yeah, I got THAT song, b***h.” She went on ranting, “You know the one that sold the most, the one that streamed the most… The one that had your grandma popping her p***y on TikTok.”
    She also explained that her activism in politics was only one of the many reasons why this year was her year. “Using my money, my own money, to meet up with these candidates like Bernie [Sanders]. Flying out, tired after shows. Yeah that’s me, b***h,” the Grammy-winning raptress added. “I represent America. Okay. And I wanted a change and that’s exactly what the f**k I did… I’m just that b***h. Eat it up with a spoon.”

    Meanwhile, Cardi expressed her gratitude for the title in the caption. “Thank you Billboard!Now I can bring up the stats but that will take me all day,” she wrote. “B***h broke records!” The mother of one also thanked her fans BARDIGANG. “with out y’all encouraging while the world was against me and criticizing every move I wouldn’t have gotten here everyday and use my voice for a change,” she concluded.

    Also among the award recipients at the 15th annual Women in Music celebration are Dolly Parton, Dua Lipa and Jennifer Lopez. Dua Lipa will be handed the Powerhouse Award and Dolly will take home this year’s Hitmaker Award. Meanwhike, J.Lo will be feted with another Icon prize by Billboard. Hosted by Teyana Taylor, the event will air at 8 P.M. ET on December 10.
