Will Smith has been sued for sexual harassment and wrongful termination. Violinist Brian King Joseph, 33, has accused Smith of “predatory behaviour” while he played as part of the band on the actor’s Based On A True Story: 2025 Tour in 2024.
Smith’s lawyer has denied the claims. They told Daily Beast: “Mr Joseph’s allegations concerning my client are false, baseless, and reckless. They are categorically denied, and we will use all legal means available to address these claims and to ensure that the truth is brought to light.”
Daily Star has contacted Will Smith’s representatives for comment.
Variety has reported that in the suit, Joseph claimed Smith had been “grooming and priming” him “for further sexual exploitation” while on tour. They allegedly met in November 2024 after Smith hired Joseph to perform at a show in San Diego.

Joseph, who previously appeared on America’s Got Talent, claims Smith also asked him to join his 2025 tour and perform on his upcoming album. Joseph alleges that Smith told him: “You and I have a special connection that I don’t have with anyone else.”
The musician joined Smith’s tour in March of that year for a Las Vegas performance. Hotel rooms had allegedly been booked for crew and the band, and Joseph claimed that his bag containing the hotel room key went missing for hours before management discovered the luggage and returned it to him.

Joseph alleges that management were the “only individuals with access to [his] room” and alleges that later that night, he returned to his room and discovered someone had “unlawfully” entered and left behind a number of belongings.
These allegedly included wipes, a bottle of HIV medication with another individual’s name, along with a note that reportedly read: “Brian, I’ll be back no later [sic] 5:30, just us (drawn heart), Stone F.”

Joseph interpreted the message as a warning that “an unknown individual would soon return to his room to engage in sexual acts” with him. Joseph claims he informed hotel security, Smith’s reps and also contacted a non-emergency police phone line.
The musician alleges that a member of management “shamed” him for what happened and informed him of his termination. The suit claims that this caused PTSD and economic loss, and Joseph is suing for retaliation, wrongful termination and sexual harassment with damages to be determined by a jury.
