Meghan’s brand ‘As Ever’ has found itself barred from selling clothes under the name – authorities have called the brand ‘virtually identical in appearance’ to a Chinese competitor
Meghan Markle has been barred from selling clothes under her new brand “As Ever” due to pre-existing clothing traders having the same name.
Meghan’s lawyers sought permission from the US Patent and Trademark Office so she could sell cooking aprons, jams, dog biscuits and other items of clothing under the brand, but the request was later denied. An 145-page partial rejection letter was sent by USPTO as a result of the Chinese clothing brand ASEVER name being alike. The clothing brand supplies high street fashion fave H&M with clothes and often contributes to other fashion retailers.
USPTO said: “The marks are identical in sound and and virtually identical in appearance and are thus confusingly similar for the purposes of determining likelihood of confusion.”
Markle and her team of lawyers took action and revised their application in January 2024, to exclude her clothing line. This resulted in the application for ‘As Ever’ being later approved.
The Duchess of Sussex has teamed up with Netflix to release some of her lifestyle products in their stores. This launch will come after her long awaited Netflix series ‘With love, Meghan’ which is set to debut on March 4 of this year.
Meghan recently said online: “I’m shocked we’ve kept this a secret for so long. In two weeks my show is coming out, which I’m excited for. And also my business, which I think there has been a lot of curiosity about.”

However, it wasn’t long before the lifestyle brand was met with more difficulty. The Mayor of Porreres, Majorca, accused the brand of copying the town’s coat of arms and using it in their logo, reports Sun.
There have also been reports of Mark Kolski who owns a vintage clothing store in New York called ‘As Ever’ having discussion with lawyers about the names.
While the brand has been met with controversy overseas, the company has registered to trademark their name in the UK which is still awaiting approval.
