Dave Grohl says Nirvana's iconic Nevermind cover could be altered in wake of lawsuit

Dave Grohl says Nirvana’s iconic Nevermind cover could be altered in wake of a lawsuit by the man who appeared on it as a baby.

Spencer Elden sued the band for child pornography last month almost 30 years after the image of him swimming nude in a pool as a baby was used as Nevermind’s iconic album art.

Nirvana and Foo Fighters star Grohl was named as one of the defendants in the suit.

The estate of late singer Kurt Cobain was also named, in addition to bassist Krist Novoselic, photographer Kirk Weddle, Universal Music, Geffen Records, Warner Records and MCA Music.

In a chat with The Sunday Times, Grohl says he has plans to alter the front cover for release to celebrate 30 years of the album.

He said: “I have many ideas of how we should alter that cover but we’ll see what happens. We’ll let you know. I’m sure we’ll come up with something good.”

Grohl was asked to comment about the lawsuit and replied: “I think that there’s much more to look forward to and much more to life than getting bogged down in those kinds of things. And, fortunately, I don’t have to do the paperwork.”

The legendary record is due to be re-released next month, but it’s not known when fans will get to see the reimagined artwork.

Cover star Elden is now 30-years-old and wants the artwork to be changed for any further re-releases.

His attorney Maggie Mabie said: “If there is a 30th anniversary re-release, he wants for the entire world not to see his genitals.”

He is asking for $150K from each defendants, for, “lifelong damages” from appearing on the album cover.

Elden’s lawsuit claims the band “intentionally commercially marketed Spencer’s child pornography and leveraged the shocking nature of his image to promote themselves and their music at his expense.”

“Cobain chose the image depicting Spencer — like a sex worker — grabbing for a dollar bill that is positioned dangling from a fishhook in front of his nude body with his penis explicitly displayed,” the lawsuit continues.

Back in 2016, Elden said it was “cool but weird to be part of something so important that I don’t even remember.”

He has appeared in re-enactments since but has worn swimming shorts.

Elden added: “It’d be nice to have a quarter for every person that has seen my baby penis,” before saying it would be “cool” to donate that money to suicide prevention charities.
