    How the Music Industry Learned to Love Piracy

    A recent documentary has industry bigwigs telling a galling story about the file-sharing era: Everything worked out for the best.How do you disassemble a decades-long, multibillion-dollar industry in just a few short years? This was the question at the heart of this summer’s two-part Paramount+ documentary, “How Music Got Free,” which examines the greed and myopia of the music business in the late 1990s and early 2000s, when an assortment of otherwise feckless teenagers and tech enthusiasts finally figured out how to trade songs over the internet. Depending on your perspective, it is either a delightful yarn about the money-changers in the temple getting their due or a long, sad narrative about corporations and consumers banding together to deprive artists of a fair wage.Far from demonizing the innovators of online music piracy, “How Music Got Free” regards them as digital Robin Hood figures, visionaries whose passion for technology and music leveled the economic playing field. One montage contrasts the Croesus-like wealth of artists like Master P with the hardscrabble lives of residents of Shelby, N.C., as if seeking to justify piracy in one persuasive sweep of social-realist juxtaposition. Shelby is the home of Bennie Lydell Glover, a computer wizard and CD-manufacturing-plant employee who smuggled countless embargoed records onto the internet — a pipeline of prerelease material large enough to affect the sales of artists as big as Kanye West and 50 Cent. The documentary is also quick to point out the orgiastic profits reaped by record labels during the ’80s and ’90s, when CDs could be manufactured for around $2 and sold for $20, a practice that proved doubly lucrative as the new format induced consumers to buy their record collections all over again. The old expression goes: Pigs get fat; hogs get slaughtered. When the damage was done — from 2006 to 2016, CD sales dropped 84 percent — an entire generation had internalized the notion that they should never expect to pay anything for the music they cherished. The carnage could scarcely be calculated.“How Music Got Free” offers a sympathetic look back at the early days of this paradigm shift, but it’s worth remembering how music moguls and corporations actually responded to piracy at the time. Their reaction might best be described as a Keystone Kops-style combination of outrage, threats and litigation that mirrored the general stages of grief. Their indignant protests had a plaintive message: “You’re stealing from your favorite artists!” The unspoken second half of that was: “That’s our job!”This is worth remembering specifically because “How Music Got Free” was produced by Eminem, among others, and features a parade of industry bigwigs including Jimmy Iovine, 50 Cent, Timbaland and Marshall Mathers himself. Today the documentary treats the rise of online file-sharing services as first an astonishment, then a nuisance, then an existential threat and then, amazingly, a panacea. The original pirates are judged to be “pioneers” who lit the only clear path forward for the music industry. That path turns out to be streaming, a neat compromise between letting consumers listen to whatever they want online and collecting just enough money for it that big record labels are satisfied with their cut. A highly weird coda praises the contemporary streaming economy as a populist breakthrough, wherein, per the documentary’s narration, “we are one step closer to an artist being able to chart their own course.” Also: “Fans can experience music in their own ways.” Also, per one Panglossian talking head: “If you like music, you have more opportunities.” Also: “The artists themselves are just having more direct relationships with the consumers,” which — what does this even mean?History is written by the winners, and Eminem, Iovine and the rest of the plutocrats involved with “How Music Got Free” are clear victors in the aftermath of the piracy wars. What is left unmentioned, of course, is the surrounding blast crater, which has functionally erased a once-thriving ecosystem of middle-class musicians. Those artists survived on the old model of physical sales and mechanical royalties; now they have been almost completely excised from the profit pool of the streaming economy. Perhaps you have read the numbers and wrangled with their penurious abstractions. Per the Recording Industry Association of America, streaming currently accounts for 84 percent of revenue from recorded music. One estimate had streaming platforms paying an average of $0.00173 per stream; more recent numbers have it as $0.0046. Either way, a majority of that princely sum is typically captured by record labels, while the artist is left to make do with the remainder. I will save you the trouble of getting out your calculator.     Pay $1 to Hear Wu-Tang Clan’s Secret Album (Eventually)

    An online art collective that spent $4 million on “Once Upon a Time in Shaolin” is telling fans their purchases will accelerate the one-of-a-kind album’s 2103 release date.Ten years ago, the most mysterious and expensive album of all time was announced by the Wu-Tang Clan as a protest against the devaluation of creativity in the age of the internet. “Once Upon a Time in Shaolin,” limited to one hyperdeluxe physical copy, was bought for a reported $2 million by the “pharma bro” Martin Shkreli and later acquired by an online art collective for $4 million.Now it can be yours for a dollar.     Sony Reaches Blockbuster Deal for Michael Jackson’s Catalog

    The richest music catalog deal to date would give Sony half of Jackson’s recorded music and songwriting rights, valuing the total collection at $1.2 billion or more.Sony has agreed to acquire half of Michael Jackson’s catalog from the star’s estate, in what is likely the richest transaction ever for a single musician’s work, according to two people briefed on the agreement.The deal, which has been gossiped about in the music industry for months, is said to involve Sony purchasing a 50 percent stake in Jackson’s recorded music and songwriting catalogs. That includes not only the estate’s share of megahits like “Beat It” and “Bad,” but also the music publishing assets that are part of Jackson’s Mijac catalog, among them songs written by Sly Stone and tracks made famous by artists like Ray Charles and Jerry Lee Lewis.The deal is said to value Jackson’s assets at $1.2 billion or more, according to the two people, who were granted anonymity because they were not authorized to speak publicly about it.     Universal Music Group Threatens to Remove Music From TikTok

    The company has been renegotiating the contract that licenses its vast catalog of songs to the social media platform. The agreement expires on Wednesday.Universal Music Group, the world’s largest music company, said it would revoke the licenses for its vast catalog of songs from TikTok after its current contract expires on Wednesday if the two companies could not reach a new deal addressing Universal’s concerns over artist compensation, artificial intelligence and other issues.In an open letter posted late Tuesday, Universal accused TikTok of responding to its requests with “indifference, and then with intimidation,” creating a public squabble in the remaining hours of the two companies’ existing contract. If the talks fail, TikTok users would be unable to use music by Taylor Swift, Lady Gaga, U2, Bad Bunny and thousands of other artists in their videos.TikTok, owned by the Chinese company ByteDance, is one of the world’s most popular and fastest-growing social media platforms, with more than a billion users, and its influence on youth culture around the world is unmatched.     Ghostwriter Returns With an A.I. Travis Scott Song

    The anonymous artist, who stirred conversation with the A.I. track “Heart on My Sleeve,” has been quietly consulting with executives, while also gunning for a Grammy.Earlier this year, when the anonymous musical creator known as Ghostwriter released an unauthorized track that used artificial intelligence voice effects to mimic the pop superstars Drake and the Weeknd, the fallout was immediate and far-reaching.The mostly original song, “Heart on My Sleeve,” was promptly removed from official streaming services, even as experts acknowledged that its use of A.I. fell into a rapidly expanding legal gray area. But while the major record labels sought to protect their intellectual property and scrambled to prepare for disruptions to come, the track also proliferated on social media, earning millions of listens and helping to inspire a wave of similarly novel compositions.Throughout the aftermath, Ghostwriter stayed silent — at least in public.Behind the scenes, however, the shadowy act and its team were making overtures to the very industry figures “Heart on My Sleeve” had unnerved. In the months since, those behind the project have met with record labels, tech leaders, music platforms and artists about how to best harness the powers of A.I., including at a virtual round-table discussion this summer organized by the Recording Academy, the organization behind the Grammy Awards.“I knew right away as soon as I heard that record that it was going to be something that we had to grapple with from an Academy standpoint, but also from a music community and industry standpoint,” Harvey Mason Jr., a producer who is the chief executive of the Recording Academy, said in an interview. “When you start seeing A.I. involved in something so creative and so cool, relevant and of-the-moment, it immediately starts you thinking, ‘OK, where is this going? How is this going to affect creativity? What’s the business implication for monetization?’”Mason said he had contacted Ghostwriter directly on social media after being impressed with “Heart on My Sleeve.” He added that Ghostwriter attended the meeting in character, including using a distorted voice.On Tuesday, Ghostwriter returned with a new track, titled “Whiplash,” this time using A.I. vocal filters to sound like the rappers Travis Scott and 21 Savage and deliver a message to the industry: “Me and Writer raise a toast,” the A.I. version of 21 Savage raps. “Trying to shadowban my boy/but you can’t kill a ghost.”The song — which was posted to social media platforms like TikTok and X, formerly known as Twitter, instead of Spotify and other proper streaming services — came accompanied by a statement that called on both Scott and 21 Savage to collaborate on an official release. “The future of music is here. Artists now have the ability to let their voice work for them without lifting a finger,” Ghostwriter wrote. “If you’re down to put it out, I will clearly label it as A.I., and I’ll direct royalties to you. Respect either way.”Representatives for Scott and 21 Savage did not immediately respond to a request for comment.A representative for Ghostwriter, who requested anonymity to not expose those behind the project — acknowledging that much of its marketing power comes from its mystery — confirmed that “Whiplash,” like “Heart on My Sleeve,” was an original composition written and recorded by humans. Ghostwriter attempted to match the content, delivery, tone and phrasing of the established stars before using A.I. components.They added that the Ghostwriter team had recently submitted “Heart on My Sleeve” for Grammy Awards in two categories at next year’s ceremony: best rap song and song of the year, both of which are awarded to a track’s writers.“As far as the creative side, it’s absolutely eligible because it was written by a human,” said Mason of the Recording Academy.He added that the Academy would also look at whether the song was commercially available, with Grammy rules stating that a track must have “general distribution,” meaning “the broad release of a recording, available nationwide via brick-and-mortar stores, third-party online retailers and/or streaming services.”Ghostwriter’s representative said they were aware of the commercial availability requirement.The Ghostwriter team noted in a statement that it hoped to raise awareness about the creative and business possibilities of A.I. voice filters, comparing the technology to the early days of hip-hop sampling or user-generated content on YouTube. It offered examples like the ability to do karaoke in the voice of one’s favorite artist; at-home creators making original music à la fan fiction; or artists’ estates using the filters for posthumous original releases.With guidance from Mason, the Recording Academy and its partners in the industry, the team said it hoped to work with stakeholders to build a platform that ensures artists who choose to license their voice can control how it is used and make sure they get paid when it is.“Ghostwriter really has played an important role here to bring awareness and attention,” Mason said. “We know A.I. is going to play a role in our business.     In Echo of Soviet Era, Russia’s Movie Theaters Turn to Pirate Screenings

    In a Cold War throwback, some venues are showing bootleg versions after Hollywood studios pulled films from the country. Still, viewer numbers have tanked.Since the invasion of Ukraine, Hollywood’s biggest studios have stopped releasing movies in Russia, and Netflix has ceased service there. But recently, some of the companies’ films have started appearing in Russian movie theaters — illegally.The screenings are reminiscent of the Soviet era, when the only way to see most Western films was to get access to a pirated version. Whereas those movies made their way to Russians in the form of smuggled VHS tapes, today, cinemas in the country have a simpler, faster method: the internet. Numerous websites offer bootleg copies of movies that take minutes to download.Some theaters in Russia are now openly screening pirated movies; others are being more careful, allowing private individuals to rent out spaces to show films, free or for a fee. One group, for example, rented out several screening rooms at a movie theater in Yekaterinburg, then used social media to invite people to buy tickets to watch “The Batman.”Theatergoers can also see “The Batman” in Ivanovo, a city about a five-hour drive from Moscow, in at least one venue. Before the war in Ukraine, movies produced in the United States made up about 70 percent of the Russian film market, according to state media.But despite the attempts to draw viewers, last month, Russians barely went to the movies. Theaters saw ticket sales fall by about half in March, compared with the same period last year, according to the country’s Association of Theater Owners.Artem Komolyatov, 31, a video game producer in Moscow, noticed the shift when he and his wife went on a Friday date to the movies a few weeks ago. With everything that has been going on politically, the two of them wanted to spend a couple of hours in a relaxed environment with other people, Komolyatov said, “watching something together, maybe laughing and crying.”They chose “Everything Everywhere All At Once,” a film from the independent American studio A24, which stopped releasing films in Russia in mid-April.The scene they found when they arrived at the movie theater was bizarre, Komolyatov said. “Besides us, there were three other people,” he said. “We went at 8 p.m. on a weekend. Decades ago, Soviet citizens gathered in empty office spaces, living rooms and cultural centers to view pirated copies of Western classics like “Rocky,” “The Terminator,” and “9 ½ Weeks” that had made their way behind the Iron Curtain.During the tumultuous years that followed the crumbling of the Soviet Union, piracy continued to be the main access point for Hollywood films in Russia. Movies recorded on VHS tapes that were sold at local markets were often clearly shot on a hand-held camcorder in a movie theater. Continuing a Soviet tradition, the movies were dubbed into Russian with a time delay by voice actors, often just one for all the male characters, and another for the women.Once the first Western-style movie theater opened in 1996 in Moscow, illegal distribution paths began to peter out, according to a study by the Social Science Research Council, a New York-based nonprofit. According to MRC Data, a tracking service that powers the Billboard charts, about 66 percent of all music consumption — of which streaming is by far the largest part — is for material that is older than 18 months, and that number has been growing rapidly.And for artists, the sale can bring tax advantages.     Twenty years after one of the most celebrated stars of ’90s R&B died in a plane crash, her songs — like “Try Again” and “If Your Girl Only Knew” — will be widely available.For years, it has been one of music’s most conspicuous, and puzzling, absences: The majority of the catalog of Aaliyah, the groundbreaking R&B singer of the 1990s and early 2000s, has been absent from digital services — rendering the work of one of the most influential pop stars in recent decades largely invisible, and depriving her of a proper legacy. The singer, whose full name was Aaliyah Haughton, died in a plane crash in 2001 at age 22.But on Thursday came a surprise announcement that her music will soon arrive on streaming platforms, starting with her second album, “One in a Million” (1996), on Aug. 20.Fans, including Cardi B, celebrated online. But the return of Aaliyah’s music remains fraught, with a battle still playing out between her estate and the music impresario who signed her as a teenager and retains control of the bulk of her catalog. Here’s an overview of her long unavailability on the services that dominate music consumption today.What music is coming out now?Blackground Records, founded by the producer Barry Hankerson — Aaliyah’s uncle — said it would be rereleasing 17 albums from its catalog over the next two months, on streaming services as well as on CD and vinyl. They include the bulk of Aaliyah’s output — her studio albums “One in a Million” and “Aaliyah,” along with the “Romeo Must Die” soundtrack and two posthumous collections — plus albums by Timbaland, Toni Braxton, JoJo and Tank.The releases, being made through a distribution deal with the independent music company Empire, will introduce a new generation to Aaliyah’s work. In the 1990s, she stood out as a powerful voice in the emerging sound of hip-hop: a forthright young woman — she was just 15 when she released her first album, “Age Ain’t Nothing but a Number” (1994) — who sang like a street-smart angel over some of the most innovative backing tracks of the time.“Where most divas insist on being the center of the song,” Kelefa Sanneh of The New York Times wrote in an appreciation in 2001, “she knew how to disappear into the music, how to match her voice to the bass line — it was sometimes difficult to tell one from the other.”Who is Barry Hankerson?Hankerson is an elusive, powerful and divisive figure in the music business. He was once married to Gladys Knight, and later discovered and managed R. Kelly. He built Blackground into one of the most successful Black music companies of its time, but clashed with artists. Braxton, JoJo and others have sued the label, with Braxton accusing Hankerson of “fraud, deception, and double-dealing,” according to a 2016 article on the music site Complex titled “The Inexplicable Online Absence of Aaliyah’s Best Music.”In 1991, Hankerson introduced his 12-year-old niece to Kelly, who was twice her age. Kelly, then an emerging singer, songwriter and producer, would become the primary force shaping Aaliyah’s early career, writing and producing much of her material and making Aaliyah part of his entourage.It later emerged that Kelly had secretly married Aaliyah in 1994, when she was 15 and he was 27. In the criminal case Kelly now faces in Brooklyn — which is set to begin jury selection next week — prosecutors have alleged that Kelly bribed an Illinois government employee at the time to obtain a fake ID for Aaliyah that gave her age as 18. Their marriage was annulled.After Hankerson moved the distribution of Blackground releases from the Jive label to Atlantic in the mid-90s, Aaliyah began working with two young songwriter-producers from Virginia: Timbaland and Missy Elliott. Used CDs and LPs of her work trade for eye-popping prices.Her influence has persisted, although sometimes it is more imagined than real. Last month, the singer Normani released a song, “Wild Side,” with Cardi B, that contained what many fans thought was a sample of an Aaliyah drum break. (Billboard said it is not, although Hankerson has said it would have his blessing anyway.) And interest in her story was spurred by the 2019 documentary “Surviving R. Kelly,” which delved deeply into their relationship.Although the streaming catalog has nearly reached the “celestial jukebox” level of completion that has long been predicted, there are still some other notable absences. De La Soul’s early work, including its classic 1989 debut “3 Feet High and Rising,” is not online, apparently because of problems in clearing samples. (The new owners of that music have pledged to make it available, although no concrete plans have been revealed.)Why is the music becoming available now?Exactly what led to the current release of Aaliyah’s music is unclear.According to a new article in Billboard, Hankerson began seeking a new deal for her music about a year ago, after Aaliyah’s estate made a cryptic announcement that “communication has commenced” between the estate and “various record labels” about finally getting her music online. “More updates to come,” it said.But the estate does not control Aaliyah’s recordings; Hankerson does, through his ownership of the Blackground label. For months, fans have followed more mysterious statements from the estate, including one in January, around what would have been Aaliyah’s 42nd birthday, that “these matters are not within our control.”When Blackground announced its rerelease plans, the estate responded with yet another confusing statement, saying that for 20 years it has been “enduring shadowy tactics of deception in connection with unauthorized projects targeted to tarnish,” yet expressing “forgiveness” and a desire to move on.A more direct explanation of what has been going on behind the scenes came from a lawyer for the estate, Paul V. LiCalsi, who said: “For almost 20 years, Blackground has failed to account to the estate with any regularity in accordance with her recording contracts. In addition, the estate was not made aware of the impending release of the catalog until after the deal was complete and plans were in place.”Billboard quoted a representative for Blackground in response, saying that the estate “will receive everything that it is entitled to” and that a royalty payment had been made earlier this year.For fans, the behind-the-scenes battling may matter less than the music finally becoming available online.“Baby Girl is coming to Spotify,” the service announced on Twitter, with a picture of Aaliyah. “We’ve been waiting a long time for this.” More
