    Jay Johnston of ‘Bob’s Burgers’ to Plead Guilty in Jan. 6 Case

    Jay Johnston, also known for his work on “Mr. Show with Bob and David,” was charged last year with participating in the riot at the Capitol. He is expected to plead guilty at a hearing on July 8.The actor Jay Johnston, who voiced Jimmy Pesto Sr. on the animated Fox sitcom “Bob’s Burgers,” has agreed to plead guilty in the federal case against him over his participation in the riot at the Capitol on Jan. 6, 2021.The authorities arrested Mr. Johnston, 55, in California last summer and charged him with four counts, including civil disorder and entering restricted grounds. Mr. Johnston agreed to plead guilty to a single count of civil disorder in exchange for the other charges being dropped, according to a person familiar with the case who spoke on condition of anonymity. A plea agreement hearing is scheduled for July 8 in the U.S. District Court for the District of Columbia.A civil disorder charge carries a maximum prison sentence of five years, or a fine or both.Mr. Johnston was a regular on the groundbreaking 1990s television comedy “Mr. Show with Bob and David” and later had recurring roles on “The Sarah Silverman Program” and “Arrested Development.” His movie credits included “Anchorman” and “Men in Black II.”He was quickly named by internet sleuths when the F.B.I. published photos of him at the Capitol on Jan. 6, 2021, in asocial media post asking for the public’s help identifying him.The authorities also identified Mr. Johnston in police body camera and security footage of him pushing against officers and helping rioters push through a tunnel entrance into the Capitol, according to an affidavit prepared by the F.B.I.He is seen taking photos of the crowd, signaling others to join the push and giving water to rioters, who used it to wash their eyes out, according to the affidavit.Additionally, three people who know Mr. Johnston identified him to investigators in the images at the Capitol. One of those people showed investigators a text message sent by Mr. Johnston in which he admitted to having been at the Capitol.“The news has presented it as an attack,” the message stated, according to court documents. “It actually wasn’t. Thought it kind of turned into that. It was a mess. Got maced and tear gassed and I found it quite untastic.”Mr. Johnston had also booked a round trip from Los Angeles to Washington D.C., with his departing flight on Jan, 4, 2021 and his return set for three days later, according to court documents.The Daily Beast, an online news site, reported in December 2021 that Mr. Johnston lost his job voicing Jimmy Pesto Sr. on “Bob’s Burgers” after allegations spread that he had been at the Capitol.Mr. Johnston is one of more than 1,500 people to be charged for actions related to the Capitol riot on Jan. 6, according to the Justice Department.     Revelations that Alexander Smirnov, an F.B.I. informant, was a serial fabulist were downplayed on air and online by those who continued to insist the president should be impeached.On Tuesday, a few hours after the credibility of a key source boosting Republican efforts to impeach President Biden collapsed in spectacular fashion, the Fox News host Jesse Watters offered his viewers a reassuring message.“It’s a smear job,” Mr. Watters said.He was referring to the Justice Department’s revelation that Alexander Smirnov, an F.B.I. informant who had accused Mr. Biden and his son Hunter of an elaborate bribery scheme involving Ukraine, was in fact a serial liar who could not be trusted. In a court filing, federal prosecutors said Mr. Smirnov had spread misinformation and was “actively peddling new lies that could impact U.S. elections after meeting with Russian intelligence officials.”Because Mr. Smirnov’s claims were frequently cited by congressional Republicans in their now-stalled attempt to unseat Mr. Biden from office, Democrats argued that the impeachment effort had reached a logical conclusion. “He is lying, and it should be dropped and it’s just been an outrageous effort from the beginning,” the president said last week.But the conservative media world reacted with a different, and sharply defiant, narrative.     Leon Wildes, Immigration Lawyer Who Defended John Lennon, Dies at 90

    Leon Wildes, a New York immigration lawyer who successfully fought the United States government’s attempt to deport John Lennon, died on Monday in Manhattan. He was 90.His death, at Lenox Hill Hospital, was confirmed by his son Michael.For more than three years, from early 1972 to the fall of 1975, Mr. Wildes (pronounced WY-ulds) doggedly battled the targeting by the Nixon administration and immigration officials of Mr. Lennon, the former Beatle, and his wife, Yoko Ono, marshaling a series of legal arguments that exposed both political chicanery and a hidden U.S. immigration policy.Uncovering secret records through the Freedom of Information Act, he showed that immigration officials, in practice, can exercise wide discretion in whom they choose to deport, a revelation that continues to resonate in immigration law. And he revealed that Mr. Lennon, an antiwar activist and a vocal critic of President Richard M. Mr. Lennon had been convicted of marijuana possession in London in 1968; that record would normally have barred him from entry, but he had obtained a waiver. The waiver was coming to an end, and the Lennons received a deportation notice.“It was a very frightening moment,” Ms. Ono said in the 2007 documentary “The U.S. vs. John Lennon.”When the Lennons engaged Mr. Wildes to represent them, he had barely heard of his famous clients. In his book about the case, “John Lennon vs. the USA,” published by the American Bar Association in 2016, he wrote that he was vaguely aware of the Beatles — it was nearly impossible not to be — but that the names of its members had escaped him.“I think it was Jack Lemmon and Yoko Moto,” he recalled telling his wife after meeting them in their apartment on Bank Street in Greenwich Village. She quickly corrected him.In the 2007 film, Mr. Lennon is seen telling reporters about Mr. Wildes: “He’s not a radical lawyer. He’s not William Kunstler.”Mr. Lennon had publicly opposed the Vietnam War — he recorded the antiwar anthem “Give Peace a Chance” in 1969 — and he had been involved in protests on behalf of figures in the New Left movement, which campaigned against the war.Nixon administration officials feared that he had outsize influence among the young, who would be allowed to vote in greater numbers in the 1972 presidential election, the first after the voting age had been lowered to 18 from 21. In the paranoid atmosphere then prevailing in the White House, that was enough for administration officials and their allies, notably the conservative South Carolina senator Strom Thurmond, to go after Mr. Lennon.Their case centered on the London marijuana conviction. But the appellate court judge, Irving Kaufman, ultimately ruled that the crime was insufficient to make Mr. Lennon an “excludable alien.”The real reasons for the quixotic pursuit of Mr. Lennon, Mr. Wildes argued, lay elsewhere, as he was able to show thanks to his relentless digging through records. Early in 1972, Mr. Thurmond had drafted a letter recommending that Mr. Lennon be thrown out of the country, which Attorney General John N. Mitchell forwarded to the Immigration and Naturalization Service, the agency then in charge of visas. Of particular concern was the fact that Mr. Lennon had performed at a rally in support of a New Left figure, the poet John Sinclair, who had been jailed on a marijuana charge.“If Lennon’s visa is terminated it would be a strategic countermeasure,” the South Carolina senator wrote.Ten days later, “a telegram went out to all immigration offices in the United States instructing that the Lennons should not be given any extensions of their time to visit the United States,” Mr. Wildes wrote in his book.For the next three years, the government continued to press its case, in efforts that appeared increasingly ham-fisted as public support for Mr. Lennon and Ms. Ono grew. In letters and testimony, many of the era’s cultural celebrities spoke up for them, including Bob Dylan, Joan Baez, Leonard Bernstein, the artist Jasper Johns and the authors John Updike, Joyce Carol Oates and Joseph Heller, as well as Mayor John V. Lindsay of New York.“The sole reason for deporting the Lennons was President Nixon’s desire to remove John and Yoko from the country before the 1972 election and a new, much younger electorate getting the vote,” Mr. Wildes wrote. “To ensure his grip on power, any ‘dirty tricks,’ including the abusive misuse of the immigration process, were acceptable.”Mr. Wildes, seated, consulted with his partner, Steven Weinberg, at their immigration law office in 1983.via Wildes Family ArchivesThe whole time, the F.B.I. was keeping a close watch on Mr. Lennon. “Surveillance reports on him ran to literally hundreds of pages,” Mr. Wildes wrote.When Mr. Lennon learned of the skulduggery, he was infuriated. “They’re even changing their own rules because we’re peaceniks,” he said in a television interview.The 1975 ruling allowed him to remain in the country. He was killed in front of the Dakota, the Upper West Side building where he and Ms. Yoko lived, five years later.In another breakthrough, Mr. Wildes found that immigration officials had the discretion to deport or not, depending on whether there were extenuating circumstances. The revelation of this policy continues to aid immigration lawyers battling the deportation of noncitizens today.“As part of his legal strategy, Wildes conducted groundbreaking research on the ‘nonpriority’ program, and eventually filed an application for ‘nonpriority status’ for Lennon,” the immigration expert Shoba Sivaprasad Wadhia wrote in her 2015 book, “Beyond Deportation.” “Wildes learned that I.N.S. had for many years been granting ‘nonpriority’ status to prevent the deportation of noncitizens with sympathetic cases, but I.N.S. had never publicized the practice.”Throughout what Mr. Wildes acknowledged was the all-consuming job of representing the Lennons, he kept a bemused and friendly eye on his famous clients, sometimes encountering them, as others did, in what he called the “wonderful upright bed” in their Bank Street apartment.“One could meet half the world around that bed,” he wrote — “radical types like Jerry Rubin or Bobby Seale, oddball musicians like David Peel, poets like Allen Ginsberg, actors like Peter Boyle, television personalities like Geraldo Rivera, or even political operatives like the deputy mayor of New York.”Mr. Wildes at his office in 2015. “He’s not a radical lawyer,” John Lennon said. “He’s not William Kunstler.”via Wildes Family ArchivesLeon Wildes was born on March 4, 1933, in Olyphant, Pa., a small coal-mining town near Scranton. Mr. Wildes was educated at public schools in Olyphant and earned a bachelor’s degree from Yeshiva University in 1954 and a law degree from New York University in 1958.He quickly gravitated toward immigration law, working for the Hebrew Immigrant Aid Society, a refugee aid organization, and helping two Americans who had gone to Israel establish their U.S. citizenship. He founded the immigration law firm Wildes & Weinberg in 1960 and went on to write numerous law review articles on immigration law and to teach at the Benjamin N.     ‘Reality Winner’ Review: Caught in the Cross Hairs

    Sonia Kennebeck’s documentary unpacks the circumstances surrounding its subject, but fails to crack her complexity.It is not always fruitful to compare a documentary about an event with a narrative film portraying that event. Yet “Reality Winner,” Sonia Kennebeck’s hazy nonfiction chronicle of Reality Winner — a National Security Agency contractor who was sentenced under the Espionage Act in 2018 when she was 26 — and this year’s film “Reality,” a searing dramatization of her interrogation, form a tidy double feature. The latter eschews context to paint an evocative real-time picture of a young woman in the F.B.I.’s cross hairs; the former painstakingly maps out the state of affairs surrounding Winner, only to see her personhood trickle away, like water cupped in one’s palms.Rotating among a handful of timelines, Kennebeck’s documentary spends the most time with Winner’s parents and sister as they push for Winner to receive a fair trial. These scenes are interspersed with blurred re-enactments (not unlike those starring Sydney Sweeney in “Reality”) and actual field-recording audio, as well as an interview with Winner, who orates directly into the camera à la Errol Morris’s Interrotron technique.One of the more troubling aspects of this complex case was The Intercept’s mishandling of the leaked document, and “Reality Winner” unpacks how The Intercept’s actions contributed to exposing Winner’s identity to the N.S.A. Indeed, the documentary’s most valuable testimonies come from other whistle-blowers (including Edward Snowden) who come across as extraordinarily well equipped to analyze the story’s knottier details.Despite this access, “Reality Winner” fails to decode its ideologically heterodox subject. The film is clear in showing how the media put her into boxes: a traitor, a terrorist, a progressive, an innocent, a lost cause. But who is Reality Winner?     The actor was banned from the animated sitcom in 2021 after he was accused of participating in the Capitol riot.Jay Johnston, a comic actor known for his work on the animated sitcom “Bob’s Burgers,” was arrested in California on Wednesday and charged with felony obstruction of police officers during the riot at the Capitol on Jan. 6, 2021.The actor was identified in police body camera footage pushing against officers and aiding other rioters at the Capitol, according to the F.B.I.Mr. Johnston, 54, was charged on four counts, including civil disorder and entering a restricted building. An F.B.I. affidavit states that images from closed-circuit television show Mr. Johnston using a shield stolen from the Capitol Police to join a group assault on officers defending a tunnel entrance to the building.Mr. Johnston’s name surfaced in connection with the riot in March 2021 when amateur sleuths said they recognized him in photographs shown in an F.B.I. call for tips on Twitter. Prosecutors have indicated that there could be as many as another 1,000 people who might eventually face charges, according to people familiar with the matter.The owner of a Long Island funeral home, Peter G. Moloney, was also charged on Wednesday in the department’s investigation of the riot. He is accused of spraying an insecticide at police officers guarding the Capitol and attacking members of the news media.Last month, Richard Barnett, who was photographed with his boot on Speaker Nancy Pelosi’s desk during the attack, was sentenced to four and a half years in prison after being found guilty in January on eight criminal offenses.Stewart Rhodes, the leader of the far-right Oath Keepers militia, received the most severe penalty so far from criminal cases stemming from the Capitol attack. He was sentenced last month to 18 years in prison for his conviction on seditious conspiracy charges.Mr. Johnston has a long list of television and movie credits, mostly in comedic roles.     ‘The Picture Taker’ Review: Civil Rights Photographer and F.B.I. Informant

    The documentary, by the director of “Who Killed Malcolm X?,” is a compelling biography of Ernest Withers, whose photographs helped chronicle Black history.After the photojournalist Ernest Withers died in 2007, a bombshell investigation revealed that the respected Memphis photographer, known for taking over a million pictures of 20th-century Black life during his career, had also been a paid informant of the F.B.I.The documentary “The Picture Taker,” directed by Phil Bertelsen (“Who Killed Malcolm X?”), uses this fact as an entry point into a compelling biography of Withers, whose photographs helped chronicle important events in the civil rights movement, including the Rev. Dr. Martin Luther King Jr.’s final days spent supporting the 1968 sanitation workers’ strike in Memphis.“The Picture Taker” presents several perspectives on Withers’s link to the F.B.I. and noticeably does not come down on a particular side — unlike “Judas and the Black Messiah,” a 2021 historical drama about the murder of the activist and Chicago Black Panther Party leader Fred Hampton, which took up similar subject matter.But the reason to watch the documentary isn’t for the debate about Withers’s motives. It’s to see his impressive archive, which Bertelsen was smart to build the film around.
    From his coverage of the Emmett Till trial in Mississippi to the weddings and first communions of everyday Black people in Memphis, Withers’s photographs give the documentary a visual language that coheres from start to finish.“The Picture Taker” artfully plays with rendering the photographic image for the screen. It graphically alters Withers’s likeness, transforming pictures of him into telling animations and cutouts that pull him out of the background in which he so often dwelled and into the foreground.Ultimately, the film immerses viewers in Withers’s considerable storytelling abilities as an image-maker at the same time that it examines his motives for taking those very pictures — that tension is what makes for an engrossing watch.The Picture TakerNot rated.     ‘The Anthrax Attacks’ Review: Strange Behavior and an Incriminating Flask

    This documentary by Dan Krauss revisits the case against a scientist the F.B.I. maintained was responsible for a series of bioterrorism attacks after Sept. 11.In the weeks following the attacks on Sept. 11, 2001, news organizations and two United States senators were sent letters that contained deadly anthrax spores. These bioterrorist attacks killed five people and sickened at least 17 others. In 2010, the Federal Bureau of Investigation closed the case and continued to maintain that the perpetrator was Bruce E. Ivins, an Army biodefense expert who killed himself in 2008 as preparations to indict him were underway.In “The Anthrax Attacks,” the director Dan Krauss (the 2014 documentary “The Kill Team,” which he later reworked into a dramatized feature) takes viewers through the investigation. While much of the movie plays as a standard documentary — it features interviews with scientists, former F.B.I. agents, victims of the attacks and the sister of a postal employee who died — it makes substantial use of re-enactments.The actor Clark Gregg stars as Dr. Ivins, and a title card says that his words were taken directly from Ivins’s emails. As portrayed in the documentary, Dr. Ivins was operating under the investigators’ noses. His strange behavior, the timing of his lab activities and his access to an incriminating flask are all held out as evidence against him, although the evidence, the film notes, was also largely circumstantial and lacked a firm link between Dr. Ivins and the mailings themselves.Still, it is slightly sneaky for the film to set up Dr. Ivins as the obvious suspect by making him the film’s center — and by having Gregg play him as an officious, mild-mannered weirdo — only to raise doubts toward the end, in particular pointing to a 2011 report that said the available scientific evidence did not make it “possible to reach a definitive conclusion about the origins of the anthrax.” Many documentaries have dealt with real-life ambiguity by making it part of their structure and argument.     ‘Rust’ Investigators Release Crime Scene Photos, Await Key Evidence

    The criminal investigation of Alec Baldwin’s fatal shooting of a cinematographer on a film set cannot be completed without key ballistics and other evidence, the Santa Fe County sheriff said.The Santa Fe County Sheriff’s Office released silent footage of Alec Baldwin practicing a scene with a revolver on the set of the Western before accidentally shooting and killing the film’s cinematographer, Halyna Hutchins.Six months after Alec Baldwin fatally shot a cinematographer on the set of the movie “Rust,” raising questions about who was culpable and how live ammunition got onto the set, the Santa Fe County sheriff’s office said Monday it still lacked key pieces of evidence, including ballistics analysis, that it said it needed to complete its criminal investigation.The sheriff’s office discussed the wait for evidence as it took the step of releasing a trove of files relating to the “Rust” investigation, including witness interviews; lapel and dash camera footage; crime scene photos; text messages between members of the crew in the days before and after the shooting; and videos of Mr. Baldwin practicing with the gun in the church where the deadly shooting occurred.The office has been investigating the death of the cinematographer, Halyna Hutchins, 42, who was shot and killed in New Mexico on Oct. 21 during the rehearsal for a scene that required Mr. Baldwin to draw a replica old-fashioned revolver from a shoulder holster that he had been told contained no live ammunition.The gun went off, discharging a bullet that killed Ms. Hutchins and injured Joel Souza, the film’s director. Since then, the sheriff’s office in Santa Fe has been gathering evidence and investigating the circumstances surrounding the shooting.The files released Monday included new details about the case, including a report of a phone call that one investigator, Detective Alexandria Hancock, had on Nov. 3 with Mr. Baldwin. Mr. Baldwin said that he had pulled the hammer of the gun about three-quarters of the way back and then let the hammer go, at which point the gun discharged, the report said. Mr. Baldwin told Detective Hancock that his finger had been on the trigger but that he did not pull the trigger, it said. Detective Hancock wrote that she tried to explain to him that if his “finger was on the trigger, and if he was pulling the hammer back with his thumb, his index finger may have still had enough pressure on the trigger for him to depress it.” She added that “Alec advised he never tries to pull the trigger on a gun unless they are rolling the camera.”But as it released the new materials, the sheriff’s office said it still lacked important building blocks of its investigation to be able to pass the case to the Santa Fe County district attorney for review.The Santa Fe County sheriff’s office released photos from its investigation of the fatal shooting of the cinematographer Halyna Hutchins on the set of the film “Rust.” Santa Fe County Sheriff’s OfficeSheriff Adan Mendoza said in a statement that “various components of the investigation remain outstanding,” including firearm and ballistic forensics from the Federal Bureau of Investigation, DNA and latent fingerprint analysis, a report from the New Mexico Medical Examiner’s office and the analysis of Mr. Baldwin’s phone data, which was extracted by investigators in Suffolk County, N.Y.“Once these investigative components are provided to the sheriff’s office, we will be able to complete the investigation to forward it to the Santa Fe district attorney for review,” Sheriff Mendoza said in a statement issued by his office.Mary Carmack-Altwies, the Santa Fe County district attorney, said in a statement on Monday that although investigators have sent over a portion of their inquiry to her office, detectives cannot send over a completed investigation until they receive certain reports.“Once we receive the completed investigation and conduct a thorough and deliberate review of all evidence, a criminal charging decision will be made,” Ms. Carmack-Altwies said in the statement.The University of New Mexico, where Ms. Hutchins’s autopsy is being performed, is not yet finished with its report, said a spokesman, Mark Rudi. The shooting took place on the set of a church.via Santa Fe County Sheriff’s OfficeA spokesman for the sheriff’s office, Juan Rios, said that the investigation was not taking longer than normal for what was “a complicated and convoluted case.”He said the office had decided to release the files in bulk because of multiple requests from the media, and from attorneys involved with the case, and because the office wanted to show what was still outstanding. “This is an update,” he said. “We wanted to identify what remains.”The F.B.I.’s national press office declined to comment regarding the time it was taking to complete its firearm and ballistic investigation, and directed inquiries to local law enforcement officials.
