Johnny Depp's pal claims Amber Heard had no marks on face after alleged 2016 incident

Johnny Depp’s neighbour has claimed that Amber Heard had no marks on her face after an incident where she accused the actor of hitting her.

Taking the stand on Wednesday (April 13) the second day of evidence in the defamation case between the two Hollywood stars Isaac Baruch revealed details of an alleged incident on May 21, 2016.

Mr Baruch recalled how following an evening out he had arrived home to the penthouse floor of the Eastern Columbia building where Mr Depp, 58, and 35-year-old Ms Heard also lived.

He described to the court how he had seen shattered glass on the ground and wine splashed on the walls and pooled on the floor.

Concerned at what had happened Baruch claimed he had knocked on the door of another Penthouse, where a friend of Heard’s, Josh Drew, opened the door to him saying it had been a “rough night”.

Mr Baruch then told the court in Fairfax, Virginia, that the following morning he saw Heard, Drew, and a man dressed in black talking in the hallway.

Asked what had happened, Heard replied: “Johnny came by last night, and he got violent. So I’m changing the locks on [penthouses] 1, 3 and 5.”

Baruch said Locksmiths were working on one of the doors at the time and he was asked how the lighting was in the hallway when he saw her and he replied it was bright.

He then testified he saw no bruises, redness, or swelling on Heard, and she was not wearing make-up.

He told the court: “I say to Amber, ‘He hit you?’ And she says, ‘Yeah, he threw a phone at me, and hit me.’ And I go, ‘Where?’ And she puts her head out, to show me the right eye of her face.

“I inspect her face. I don’t see anything. I don’t see a cut, a bruise, swelling, redness. It’s just Amber’s face. It sounds nuts.”

Mr Baruch said he then kissed Heard on the face to say goodbye, noting she did not flinch or have a response.

He said he saw Heard again the following day, his birthday, May 22, but no bruises had appeared. He then claimed to see her again the following week with no apparent bruises.

Baruch then explained how he had later seen a photo of Heard on the internet with injuries on her cheek.

He recalled that he thought: “What the hell is this?” before subsequently learning the couple had filed for divorce.

Baruch claimed that the next time he saw Heard he told her: “Me and you are not going to talk anymore. After everything I’ve seen over the past week and change. I’m confused and frustrated and angry by everything I’ve seen.”

She allegedly replied: “I’m sorry you feel that way.”

Baruch then recalled how he had later seen a security video of Heard and her sister in which her sibling threw a fake punch at the actress, causing them both to laugh.

Mr Baruch later broke down in tears on the stand as he explained why he was angry with Heard and how he felt her allegations had ruined lives.

He said: “It’s (been) six years… am I angry? What I am is tired and I want this all to end.

“So many people have been affected by this malicious lie that she started and she created and it’s gone out the door and around the world.

“I’m not angry at anybody. I want the best for (Ms Heard), I want her to take her responsibility, heal, and move on.”

As he broke down and wiped away his tears he added: “For Johnny, his family has been completely wrecked by all of this stuff and it’s not fair.

“It’s not right what she did and what happened for so many people to get affected from this, it’s insane how this happened.”

A cross-examination from Ms Heard’s legal team saw Mr Baruch asked how he could be sure that Ms Heard had not been wearing make-up during their encounters following the alleged incident.

He was then asked a series of questions about the products Ms Heard would use on a regular basis when applying make-up to her face and the products she would use, which he admitted to having no knowledge of.

The focus then moved to an exchange of text messages between Baruch and Depp regarding Heard.

Heard’s lawyer Elaine Bredehof asked Baruch about messages between them and Depp’s use of the word “c***”.

He replied: “He calls me a c***.”

Bredehoft said: “Do you recall Mr Depp ever telling you that he hoped that Amber’s corpse is rotting in the f****** trunk of a Honda Civic?”

Looking down at a transcript of the messages Baruch said: “Yeah, I’m seeing it here. So obviously it was written.”

A further text message was also presented to the court where Depp claims he feels Heard – referred to as “that c***” – has “ruined the life we had” and how he “cannot bear to look at the building” where they all lived anymore.

Depp subsequently sold the apartment building. When asked if he still lives in a property owned by Depp, Mr Baruch confirmed that he does.

When asked if he would lie under oath for his friend he vehemently denied the notion.

The trial continues.
